These Terms govern your use of the NeverMiss service (the "Service"), operated by uMorphos LLC. By contacting a participating business through the Service or by sending or receiving messages through it, you agree to these Terms.
The Service
The Service provides an automated front-desk and messaging assistant that helps home-service businesses (such as roofing and HVAC contractors) respond to inquiries, qualify requests, and schedule appointments and inspections.
Text messaging terms
By providing your phone number when you contact a participating business, you consent to receive text messages from the Service related to your request, including replies, scheduling, confirmations, and reminders.
Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, and reply HELP for assistance. Carriers are not liable for delayed or undelivered messages.
Not an emergency service
The Service is for scheduling and general inquiries only. It is not a monitored emergency line. If you have a life-safety emergency, structural collapse, electrical hazard, or any situation requiring immediate help, stop using the Service and call 911 or your local emergency number.
No guarantees on pricing or outcomes
Any scheduling or information provided through the Service is preliminary. Pricing, scope, and timelines are determined by the participating business after an in-person inspection. The Service does not provide binding quotes, and does not provide legal or insurance advice.
Acceptable use
You agree to provide accurate information and not to use the Service unlawfully or to harass, abuse, or send harmful content.
Disclaimer & limitation of liability
The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, uMorphos LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
